Unauthorized Provider Services Arbitration
Pursuant to Minnesota Statute 62Q.556 Subd. 2 (c), “The commissioner of health, in consultation with the commissioner of the Bureau of Mediation Services, must develop a list of professionals qualified in arbitration, for the purpose of resolving disputes between a health plan company and nonparticipating provider arising from the payment for unauthorized provider services. The commissioner of health shall publish the list on the Department of Health's Web site, and update the list as appropriate”
Below are options through The American Arbitration Association (AAA) for health plan and provider arbitrations:
List only (PDF)
AAA acts as a referral source to identify arbitrators to serve on arbitration cases, providing a list of 5, 10 or 15 arbitrators.
List and Appointment (PDF)
AAA provides the lists and biographies as in list only and assists parties in the selection and/or appointment of the arbitrator.
AAA Healthcare ADR Services (PDF)
AAA provides the above services in addition to facilitating the arbitration per its healthcare payor provider arbitration rules.
Parties are welcome to use an alternative certified arbitration program to facilitate the arbitration in accordance with 62Q.556
